Shaikh Muhammad al-Tahir ibn Ashur is the most famous Zaytuna Imam and one among the good Islamic scholars of the 20th century. He was a student of classical Islamic scholarship with reform minded scholars. The publication of “Ibn Ashur’s Treatise on Maqasid al-Shari’ah” was a great innovation in studies on shariah within the English . In his book Ibn Ashur proposed Maqasid as a strategy for the renewal of the idea of shariah . He mentioned the sensitive topic of the intents of Prophet Muhammad (SAAS) behind his actions and decisions. He introduced criteria to differentiate between the Prophetic traditions that were meant to be a part of shariah and therefore the Prophetic actions or sayings that were meant to be for the sake of specific purposes like political leadership, court judgment, friendly advice, and conflict resolution. But his most vital contribution in this book is the great development of latest Maqasid by coining new, contemporary, terminology that were never formulated in traditional usul al-fiqh. He also initiated the concepts of ‘orderliness’, ‘freedom’, ‘rights’, ‘civility’, and ‘equality’ as Maqasid in their title , and upon which the whole shariah is based .
